Considering that software/algorithms can't be liable by themselves, I would argue that some people at the companies behind them should (and must) be held responsible. Just look at these two incidents:
- Anthropic's Claude AI escapes tests to hack 3 organizations https://www.bbc.com/news/articles/cz7dl7w8y7po
- OpenAI says its rogue AI tried to hack other companies https://www.bbc.com/news/articles/c2el319vzr3o
Instead of legal consequences to deter future misconduct, these two companies walked away with free PR.
